Terms of Service
1. Acceptance
By accessing or using Officially Human Art ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, you must not use the Service.
2. Description of Service
Officially Human Art provides a self-declaration registry where creators can record that their creative works were made without generative AI. The Service issues certificates based on creators' own declarations. Officially Human Art does not independently verify, audit, or guarantee the accuracy of any declaration made by a creator.
3. Creator Declarations
When submitting work for certification, creators make a voluntary declaration that their work is authentically human-made. This declaration is the sole responsibility of the creator. Officially Human Art acts only as a registry for these declarations and makes no independent assessment of whether a work was in fact created without AI assistance.
4. No Guarantee or Warranty
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. Officially Human Art does not warrant that:
- Any certified work is genuinely free of AI-generated content
- The Service will be uninterrupted, secure, or error-free
- Certificates will be accepted or recognised by any third party
- The evidence provided by creators is authentic or complete
5. Limitation of Liability
To the fullest extent permitted by law, Officially Human Art, its operators, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
- Your use of or inability to use the Service
- Any reliance placed on a certificate issued through the Service
- Any dispute between a creator and a buyer, collector, publisher, or any other third party regarding the authenticity or provenance of a work
- Any false or misleading declaration made by a creator
- Unauthorised access to or alteration of your data
6. Third-Party Disputes
Officially Human Art is not a party to any transaction, agreement, or relationship between creators and any third party (including buyers, collectors, galleries, publishers, or platforms). Any dispute arising from the sale, licensing, or use of a certified work is solely between the parties involved. Officially Human Art bears no responsibility for resolving such disputes and accepts no liability for any loss or damage arising from them.
7. Certificate Revocation
Officially Human Art reserves the right to revoke any certificate if there is reasonable evidence that the accompanying declaration was false or misleading. Revocation does not create any obligation on Officially Human Art's part to notify third parties or compensate any party for losses.
8. Account Responsibility
You are responsible for maintaining the accuracy of the information you provide and for all activity that occurs under your account. You must not impersonate another person or submit work created by someone else.
9. Subscriptions and Cancellation
Paid subscriptions (such as the Creator plan) are billed monthly and can be cancelled at any time from your dashboard. When you cancel:
- Your plan remains active until the end of your current billing period
- You will not be charged again after cancellation
- After your billing period ends, your account reverts to the Free plan
- All certificates you have already created remain fully active. Badges, QR codes, and verification pages continue to work as normal. Nothing is removed or deactivated
- On the Free plan, you may maintain up to 3 certified works. Additional certificates can be purchased individually
No refunds are issued for partial billing periods. You may resubscribe at any time.
10. Service Discontinuation
Officially Human Art reserves the right to suspend, modify, or permanently discontinue the Service (or any part of it) at any time, with or without notice. In the event of permanent discontinuation:
- We will make reasonable efforts to provide advance notice to registered users via email
- Active paid subscriptions will not be renewed, but no refunds will be issued for the current billing period
- Certificates, verification pages, QR codes, and badges may cease to function
- We may, but are not obligated to, provide users with an opportunity to export their data before shutdown
Officially Human Art shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
11. Modifications
Officially Human Art may modify these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the modified Terms.
Privacy Policy
1. Information We Collect
We collect the following information when you use the Service:
- Account information: Name, email address, location (optional), portfolio URL (optional), bio (optional)
- Submitted content: Artwork images, work-in-progress evidence files, descriptions, process notes, and other materials you upload
- Certificate data: Certification details including certificate IDs, submission dates, and tier classifications
- Usage data: Basic server logs including IP addresses and request timestamps
2. How We Use Your Information
We use collected information to:
- Provide the certification service and issue certificates
- Display public certificate verification pages
- Display your public artist profile (name, bio, certified works)
- Communicate with you about your account or certificates
- Maintain and improve the Service
3. Public Information
The following information is publicly visible by design:
- Your artist name and bio on your public profile
- Certificate details (title, medium, tier, dates) on verification pages
- Artwork images uploaded for certification
- Process evidence files you mark as publicly visible
Your email address is never displayed publicly.
4. Data Storage
Your data is stored on servers provided by our hosting provider. We take reasonable measures to protect your information but cannot guarantee absolute security. Uploaded files are stored as-is and served for verification purposes.
5. Data Retention
We retain your account and certificate data for as long as your account exists. You may request deletion of your account and associated data by contacting us.
6. Third-Party Sharing
We do not sell, trade, or rent your personal information to third parties. We may share information only when required by law or to protect our rights.
7. Cookies
The Service does not currently use cookies or third-party tracking scripts.
Disclaimer
Not a Verification Authority
Officially Human Art is a self-declaration registry, not a verification authority. Certificates are based entirely on creators' own statements and any evidence they choose to provide. Officially Human Art does not employ AI detection tools, forensic analysis, or any other independent verification methods.
No Professional Advice
The Service does not constitute legal, professional, or expert advice. An Officially Human Art certificate does not serve as a legal document, expert opinion, or forensic assessment. It should not be relied upon as the sole basis for any purchasing, licensing, or business decision.
Reliance at Your Own Risk
Any person or entity relying on an Officially Human Art certificate does so entirely at their own risk. We strongly recommend that buyers, collectors, and other third parties conduct their own due diligence before making decisions based on a certificate.
Copyright & Intellectual Property
Creator Ownership
All creative works submitted to Officially Human Art remain the sole intellectual property of the original creator. Registration with Officially Human Art does not transfer, assign, license, or affect copyright ownership in any way.
Limited Licence
By submitting work to Officially Human Art, creators grant Officially Human Art a limited, non-exclusive licence to display submitted images and evidence on certificate verification pages and artist profiles for the purpose of operating the Service. This licence does not extend to any commercial use of the work and may be revoked by the creator by deleting their account.
Takedown Requests
If you believe your copyrighted work has been submitted to Officially Human Art without your permission, please use the takedown form below or contact us to request its removal.
Officially Human Art Branding
The Officially Human Art name, logo, and badge designs are the property of Officially Human Art. Certificate badges and embed codes are provided for use by certified creators to display on their own websites and platforms.
Copyright Takedown
Policy
Officially Human Art respects copyright and intellectual property rights. If you believe that a work registered on our platform infringes your copyright, you may submit a takedown request using the form below.
Upon receiving a valid takedown request, we will:
- Review the claim promptly
- Notify the certificate holder of the claim
- Revoke the certificate if the claim is upheld
- Remove associated content from public display
False or misleading takedown requests may result in legal liability. By submitting a takedown request, you confirm that the information provided is accurate and that you are authorised to act on behalf of the copyright owner.
